Symantec sues for the right to call Hotbar.com apps adware PDF Print E-mail

Anti-Virus Behemoth Symantec have filed a case in the US Courts defend it’s right to produce tools that label certain parts of Hotbar.com programs as adware. A ruling in favour of Symantec would allow them to continue to produce tools that can keep our computers safe from being compromised by this type of software. Symantec are not looking for money in the case, but a ruling from the courts that clearly labels elements of the Hotbar.com software as adware or spyware and as such they can be treated as such and any risks posed managed in a controlled manner.

The suit has been filed in the US District Court for the Northern District of California, San Jose Division. This filing is just days after the online privacy group TRUSTe revoked Hotbar.coms right to display its seal of approval as detailed here.

Hotbar.com is no stranger to attempting the legal route to stop anti-spyware companies labelling their warez as evil. Last month Hotbar fired off a legal letter to Sunbelt Software to try to force them to cease labeling Hotbar products as adware or spyware. However Sunbelt responded by insisting that Hotbar.com warez meets their standards for what is evil adware or spyware.

This case will be watched closely by both sides as if Symantec win this will set a precedent for both sides on what is or is not adware, something that even the anti-spyware industry have a hard time defining. For the makers of this malicious software it will set the bar for them to mend their ways.
