Will spammer force suspension of Spamhaus domain PDF Print E-mail

In the case in the US between Spamhaus and a known spammer outfit, it has been proposed that in an attempt force Spamhaus to comply with the September ruling by an Illinois Court the Judge has called on ICANN or Tucows to pull the domain of the UK Anti-Spam outfit Spamhaus.

Spamhaus refused to acknowledge the case brought against it by a known spammer arguing that the US court lacked jurisdiction in this case. As a result it lost the case resulting in an award of $11.7m US compensation being awarded.

However, it seems that ICANN have announced that that they could not comply with any order from the court only the Internet registrar or the Internet Registry could, which would firmly plant the ball in the court of Canadian owned Tucows, who would likely not comply as they are not bound by any US law.

The move proposed by the plaintiff in the case against Spamhaus, would also have a detrimental effect on the blocking of spam on the Internet with the Spamhaus services being crucial to blocking some 50 billion spam emails a day.

Technically speaking Spamhaus could move onto a separate domain that is not under US control, however it is possible that this could open Spamhaus to being held in criminal contempt by the US courts.

Spamhaus run several block lists which are used to protect over 620 million email boxes world wide.
