A New London Superiour Count Judge has overturned the conviction of the teacher who was a victim of Spyware/Adware on a school computer that resulted in porn popups been seen by minors.

Judge Hillary Strackbein said the state had conducted further forensic investigation and that information had not been presented to the jury at the trial. The information, according to defence experts, was that the computer had generated pornographic popups and that Amero, a substitute teacher, was not at fault. Amero had been convicted of four counts of risk of injury to a minor and faced up to 40 years in prison.

This case has struck a cord with the IT Security Industry with many IT Sec professionals coming out in defence of Amero. We're all pleased that a Judge has stepped in and made the right decision, however there will be a new trial. At least this time out Julie Amero can be afforded a proper defence with export information provided to the jury to help them make the right choice on this.

The real culprit who should be on trial is the company that wrote the adware that infected the machine in the first place. But we all know that will never happen, because it is unlikely the culprit will never be traced.
